1. Acceptance of Terms
By accessing or using Travel365 Pro, our website www.travel365.pro (the "Site"), our services, or purchasing our products, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use our Site or services.
2. Services and Products
We provide travel planning and guiding services, as well as sell travel-related merchandise. Our services may include itinerary products, personalized trip planning, cruise planning, and family-hosted group trips arranged through licensed operators; travelers make their own bookings. We also host advertisements on our Site.
3. Eligibility
You must be at least 18 years old to use our services. By using our Site or services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into and comply with these Terms.
4. User Responsibilities
You agree to use our Site and services in compliance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Booking and Purchases
When you make a booking or purchase through our Site, you agree to provide accurate, current, and complete information. All bookings and purchases are subject to availability and confirmation by the relevant service providers. Prices are subject to change without notice. We reserve the right to refuse or cancel any booking or purchase at our discretion.
6. Payments
All payments must be made at the time of booking or purchase unless otherwise specified. We accept various forms of payment as indicated on our Site. You agree to pay all charges incurred by you or any users of your account and payment method at the prices in effect when such charges are incurred.
7. Cancellations and Refunds
Cancellation and refund policies vary depending on the service or product purchased. Please review the specific terms and conditions for cancellations and refunds associated with your booking or purchase. We are not responsible for any fees or penalties that may apply in the event of a cancellation or change.
Travel365 Pro does not offer refunds for fees paid for any Travel Services, to include and not limited to: itinerary purchases, Customize with Jen (Tailored), Full Custom itineraries, and cruise-planning fees. One exception: group-trip deposits are refunded in full if a trip does not reach its minimum number of families and is cancelled by us, as described on our Group Trips page.
8. Third-Party Services and Advertisements
Our Site may include links to third-party websites and advertisements. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website from our Site, you do so at your own risk, and you understand that these Terms do not apply to your use of such sites.
9. Intellectual Property
All content, trademarks, service marks, logos, and other intellectual property displayed on the Site are the property of Travel365 Pro or respective owners. You may not use, reproduce, modify, or distribute any content from the Site without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law, Travel365 Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site or services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Site; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site or services.
11. Indemnification
You agree to indemnify, defend, and hold harmless Travel365 Pro, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or services, or your violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Colorado, United States of America, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Colorado for the resolution of any disputes arising out of or relating to these Terms or your use of the Site or services.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on the Site. Your continued use of the Site or services following the posting of any changes constitutes acceptance of those changes.
